March 3, 2008
Wallace Erickson, Environmental Protection Specialist
701 Camino del Rio, Room 315,
Durango, CO 81301
Phone (9701247-5469 and FAX number (970) 247-5104.
Ronald W_ Cattany, Director
Colorado Division of Reclamation Mining & Safety
1313 Sherman Street, Room 215
Denver, CO 80203
Dear Mr. Erickson and Mr. Cattany and others Whom Concern:
50LA Lu L
This letter constitutes notice that many entities and individuals in Southern Costilla County, including
Las Comadres de San Lufs y el Condado de Costilla, the Rio Culebra. Agruicultural Cooperative, the
Costilla County Committee for Environmental Soundness (CES), The Acequia Associations and
Organizations, The Costilla County Commissioners, the Town of San Lufs, and others objecting to
the proposed Permit Amendment 3, DRMS Permit No. M-88-112, filed by Battle Mountain Gold on
December 2007.
WE do not believe that we were properly notified of this application. The Valley Courier is not our
local media source. Las Comadres de San Luis were informed of this application on 2.27.08, just
prior to the deadline. Because you do not hear from this community, please do not --ass-u-me- that
there is no opposition.
We do not believe that the Mined Land Reclamation Board has the authority to grant Battle Mountain
Gold water rights to irrigate the property formerly known as the Shalom Ranch, now being called the
Salazar Ranch. The MLRB cannot grant a change of industrial/mining water to agriculture use. Nor
should they be allowed to put water on land that has no water rights.
I personally join the other entities from my community in contesting the assertion by Battle
Mountain Gold that the West Pit water is now of pre-mining quality. I am very concerned about the
contamination of the farmland, which is adjacent to the Centennial School District and the residents
in the State's oldest Town of San Luis.
I further object to:
1. A proposal to close the water treatment facility located near the Rito Seco Creek on the Battle
Mountain Gold (BMG) property.
I further object to:
2. A proposal to irrigate the BMG property, formerly known as the Shalom Ranch, now being
called the Salazar Ranch; with water that should have been processed through the water
treatment plant which is currently in operation.
RECEIVED
MAR 10 Z008
N•'

R n
:Are 0 -Zua
Division cf Reciamationf - -'--, rn,
Mining and Safety:: klininj Gii 6„ Safety
03 ;?
CSb?eGlcan +o .4 A '
Objection to the proposed Permit Amendment 3, DRMS Permit No. M-88-112, filed by Battle Mountain Gold_
