December 2007. <br />We do not believe that the Mined Land Reclamation Board has the authority to grant Battle <br />Mountain, Gold water rights to irrigate the property formerly known as the Shalom Ranch. The <br />MLRB cannot grant a change of industrial/mining water to agriculture use. <br />The CES contests the assertion by Battle Mountain Gold that the West Pit water is now of <br />pre-mining quality. We fear contamination of the farmland, which is adjacent to the school and the <br />Town of San Luis. <br />Further, the Committee for Environmental Soundness objects to: <br />1. A proposal to close the water treatment facility located near the Rito Scco Creek on the Battle <br />Mountain Gold (BMG) property. <br />2. A proposal to irrigate the BMG property, formerly knowri as the Shalom Ranch, with water <br />that should have been processed through the water treatment plant which is currently in <br />operation. <br />3. Any proposed changes that may be harmful to or negatively impact the citizens of Costilla <br />County, especially the town of San Luis. <br />The CES S-protests that the San Luis community did not receive adequate notice about the <br />proposed amendment, as BMRI did not publish the notice in our local newspapers, La Sierra and the <br />Free Press. <br />The Costilla County Committee for Environmental Soundness respectfully requests that a <br />public hearing be held here in San Luis instead of Denver, This would allow an opportunity for <br />adequate input and response fxom our community.
