Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety has received 3B Enterprises request to <br />allow the importation of backfill materials from Twenty Mile Coal Mine. Based on the <br />waste profile report submitted with the request staff has no issue with the material. The <br />information supplied notes the material is composed of road base, coal fines and calcium <br />carbons. The estimated percentage of coal is less than 5% of the total material and <br />appears to be inert in nature. <br />In order to bring inert materials into a permitted site the permit holder must have on file <br />an affidavit stating the material is clean. Rule 3.1.5(9) notes the requirements for the <br />affidavit. A copy of the Rule has been enclosed for 313's reference. The affidavit must <br />be submitted as a Technical Revision to the permit with the appropriate fee of $216.00. <br />Due to weather and timing issues 3B is authorized to begin importation of the materials at <br />its convenience. However, the required Technical Revision for the affidavit must be <br />submitted to the Division within 30 days of this letter which is January 5, 2009 including <br />holidays.
