Natural Resource Trustee <br />10 West Main Street <br />Cortez, Colorado 81321 j / <br />Re: J-Birds Mine, Perinit No. M---2005-050, Reclamation Liability Update and outstanding issues. <br />Dear Mr. Glass, <br />The Division of Reclamation Mining and Safety has completed a reclamation liability update of the <br />above referenced permitted site. The update was based on current site conditions, proposed mine and <br />reclamation plans. The recalculation shows a slight inflationary increase in seeding and mobilization <br />tasks which are off set by better equipment efficiencies. Therefore, the current bond held of $16,646.00 <br />is adequate at this time. <br />Staff still has not received copies of the stormwater and radiation monitoring plans approved by BLM. <br />These plans should now be submitted as Technical Revisions (TR) to the pen-nit for the Division's <br />review and approval. Please note that proceeding with such plans without the Division's prior approval <br />could result in modifications to the structures already in place or planned. The plans may require <br />additional bonding that is not accounted for as of this date. These issues were noted in correspondence <br />from this office back in December. Please submit these plans for DRMS review by March 1, 2008. <br />Failure to do so may result in a "Reason to Believe" letter being issued and the matter being scheduled <br />for a formal hearing before the Mined Land Reclamation Board for failure to comply under Rule 3.3.2. <br />Current workloads do not afford staff much leeway to resolve outstanding issues.
