FES 2: 1 20N <br /> Dear Mr..Sorenson:, Division of Minerals and Geology <br /> Climax Molybdenum Company, Climax Mine hereby submits five copies of an Affected Land <br /> Exchange petition to rectify the inadvertant exclusion of 7.75 acres of reclaimed borrow area from <br /> the total affected lands and the addition 2.0 acres to affected lands to accommodate a return <br /> water pipeline relocation from the Storke complex. Climax is proposing to add this 915 acres to <br /> the affected lands in exchange for 9.95 acres of undisturbed acreage that will be removed from the <br /> affected lands. According to Division policy dated March 28, 2000 regarding such affected land <br /> exchanges, a standard request for release of reclamation liability for the exchange lands. must be <br /> approved prior to approval of the exchange. This request was submitted on February 2, 2001. <br /> As per the policy, Climax has handled all aspects of this exchange as an amendment and agrees <br /> that Division timelines for the amendment process are in effect. <br /> The completed signed (by a corporate officer)- sealed and notarized application is found in <br /> Appendix A. Other changed permit exhibits and proof of notification of county commissions in <br /> Eagle,Lake and Summit Counties and relevant soil conservation districts per Rule 1.6.2 are found <br /> in Appendix C. Likewise,certification of posting of public notice at the Climax site is found in <br /> Appendix C. Climax is sole owner of the exchange lands at issue. <br /> Proof of notification to "all Owners of record of lands that are within 200 feet of the boundary <br /> of the affected land" (Rule 1.6-2, (1)(e)(ii) will be submitted to the Division upon receipt <br /> following Rule 1.6.2 (1)(e). Likewise, proof of publication in a local newspaper for four <br /> consecutive times will be submitted following final publication and receipt of the formal affidavit. <br /> Climax submits notice to easement holders as a routine matter of business, but does not find this <br /> to be a written requirement in either the Act,the Rules, or Policy. <br /> The fee of$875.00 is attached.
