Thank you for combining the TR and the partial bond release
request together into the TR, which makes it easier for L. G. Everist, Inc. to make one bond change.
We are also requesting an extension of the decision date deadline until October 24, 2008, to allow more
time for your review and to address outstanding issues if any remain.
Slurry Wall Construction
In the adequacy review letter, the Division requested that L. G. Everist commits that the specifications
and practices for the new slurry walls that will be installed around the Parker-Panowicz, Swingle-North,
and Swingle-South phases to be at least equivalent to those used for the Golden phase slurry wall in
order to allow a 20% bond option. L. G. Everist commits to the Division's request.
Topsoiling, Seeding, Earthmoving
In the adequacy review letter, the Division requested that L. G. Everist submit topsoil replacement
acreages and seeding acreages for each phase. In your email to me on October 2, 2008, you added a
few other items to help with the bond recalculation - earthmoving, topsoil depth and distance to
replacement, pit capacity (water storage volume) and distance to discharge for the largest pit. Please
note that all acreages, volumes, and distances are conservative estimates.
Phase Name Acres to be Backfill Amounts" Water Storage Volume**
topsoiled (cubic-yards) (acre-feet)
Fort Lupton (original area) 6 384,432 2234
Golden 13 119,268 636
Hill-Oakley 5 360,290 1047
Parker-Panowicz 10 507,099 728
Swingle-North 6 466,704 743
Swingle-South 6 314,945 1094
" Estimated backfill amount for the Fort Lupton (original area) is from the original application, Exhibit L - Reclamation
Cost Estimate. Estimated backfill amounts for all other areas are from the amendment application, Exhibit F -
Reclamation Plan Map. The Hill-Oakley amount is actually the amount for Hill-Eber-Oakley, although we did not
include the Eber section in the mining/slurry wall (as noted in TR1), so the actual backfill amount would be smaller.
"" The estimated water storage volumes must be kept confidential.
FL-DRMS-TR03-AdgRevResponse-toES-1 01508.doc via Certified Mail # 7007 3020 0001 1230 6165
