Cattany <br />Division Director <br />Natural Resource Trustee <br />t? <br />Re: J-Bird Mine, Permit No. M-2005-050, IR-01, Stormwater Management Plan, Inclusion in <br />Environmental Protection Plan. <br />Dear Mr. Quinlan, <br />The Division has received Bluerock Energy's request to include the Storm-water Management Plan, TR- <br />01, in the Environmental Protection Plan (EPP) as required by the change to DMO status per HB 1161. <br />Staff feels that a stormwater management plan is an intricate part of an EPP. Therefore it appears to be <br />prudent to wait and review the plan as part of the entire EPP rather than approve something that may <br />need to be revised in a relatively short period of time. Staff visits to the permit site noted no stormwater <br />issues of immediate concern. As long as Bluerock Energy continues to uses best management practices <br />impacts should be kept at a minimum until the EPP is approved. <br />Staff believes the best course of action is to submit a letter requesting withdrawal of the Technical <br />Revision and note within the body of the text that it will be included in the required EPP to be submitted <br />by no later than February 2nd, 2009. Gault Group may submit a draft of the stormwater plan to the <br />Division for preliminary comments.
