Centennial Project, Status of Notice of Intent, Non-Confidential Portions, File No. P-2008-043 Natural Resource Trustee <br />Dear Mr. Blubaugh: <br />The Colorado Division of Reclamation, Mining, and Safety (DRMS) has reviewed your submittal dated August 21, 2008 providing <br />required additional information for the above referenced Notice of Intent to Conduct Prospecting (NOI). DRMS has determined that the <br />NOI remains incomplete. Please address the following items at your earliest convenience bearing in mind that if you have not addressed <br />these items within sixty days of the date of this letter the DRMS may terminate this NOI (rule 5.1.3 of the Mineral Rules and Regulations <br />of the Mined Land Reclamation Board). <br />Portions of the attachments to Powertech's August 1, 2008 submittal are illegible due to portions of the text being cut off at the edges. <br />The documents in question are the ten proposed drill location photographs with existing vegetation descriptions (copies enclosed). Please <br />provide fully legible replacement documents. <br />There appear to be typographical errors in sections 5.2.4(3) and 5.2.5(3) of Standard Operating Procedure (SOP) 8 as attached to your <br />submittal dated August 21, 2008 wherein reference to SOP 11 is made; the reference should be to SOP 10. Please provide a corrected <br />version. <br />You have chosen to keep the locations for the two monitoring wells confidential with the rationale being that the monitoring wells are <br />located over a minerals deposit being prospected. Be advised that as a result of this choice, data gathered from these wells may not be <br />accepted as part of a baseline characterization and monitoring plan if a Reclamation Permit application is submitted. This determination is <br />in accordance with Section 34-32-112.5(5)(c) C.R.S., which was added to Mined Land Reclamation Act through Colorado House Bill <br />2008-1161. You state in the August 21, 2008 submittal that samples collected from these wells may or may not be analyzed for the full set <br />of parameters set forth in Attachment B to that submittal. Be advised that DRMS requires analysis for the full set of parameters if you <br />intend to incorporate these wells into the baseline characterization of the site for a Reclamation Permit application. Please advise if the <br />forgoing determinations lead you to reconsider the nature of the notice of these wells under this NOI. <br />The DRMS has received reclamation bond in the amount of $55,000.00 for this NOI. Once the issues in this letter are addressed to the <br />satisfaction of DRMS, you will be issued a written authorization to proceed. If you believe that any of the information you provide in <br />response to this letter is confidential under Senate Bill 2008-228, please place that information on sheets separate from the public <br />information and clearly mark those sheets as confidential. <br />If you have any questions, please contact me at 303-866-4063. <br />Sincere , <br />A len C.
