<br />The Division of Reclamation Mining and Safety received Yellowcake's Notices of Intent for the above referenced projects on
<br />May 21, 2008. Due to a change in the law (SB 08-228), regarding confidentiality, the Notices are considered incomplete as
<br />of June 2, 2008. SB 08-228 lifts the confidentiality on some of the information submitted to the Division as part of a Notice.
<br />The non-confidential parts of the Notice shall be submitted on an electronic format as well. Information submitted such as
<br />location, size, or nature, proprietary or trade secrets may remain confidential if the applicant deems it appropriate.
<br />Yellowcake and or JBR should have received a letter from the Division noting this change. New forms are being prepared to
<br />address the changes but are not available as of this date. If Yellowcake reviews it's Notices and determines there are no
<br />confidential issues a letter lifting the confidentiality and a CD each of the applications will bring the Notices into compliance.
<br />If there are confidentiality issues, an application form and CD with those portions blacked out will suffice for these
<br />applications
<br />Because the Notices were submitted prior to the law going into effect staff will be processing the notices while JBR submits
<br />the proper documentation. However, by rule a hard decision date will not be established until the additional information is
<br />submitted and the application is considered complete.
