Since that time we have been in contact with you by phone and by <br />electronic mail. We appreciate your guidance on this issue. Please accept this letter as a <br />written request to extend the deadline to address the adequacy issues you itemized in your <br />letter. Please extend the deadline to July 21, 2008 <br />Adequacy Comment No. 1 - We have begun work with a contract engineering firm to <br />complete the AutoCAD work required for a map providing the boundaries of the area in <br />question. <br />Adequacy Comment No. 2 - American Soda will contact BLM, the landowner, to request a <br />letter from them indicating that they approve of leaving the road as a permanent feature. It <br />is our understanding that bonding of reclamation of the road will not be required by DRMS <br />if the road is acknowledged as a permanent feature by BLM. No amendment will be filed <br />to the Division regarding the road. <br />Adequacy Comment No. 3 - We shall provide documentation to the Division confirming <br />that American Soda has the right to enter and mine the portions of the permit area retained <br />by American Soda. <br />Adequacy Comment No. 4 - American Soda will affirm that there are no other mining <br />related features (wells, ditches, ponds, etc) in the subject area that have not been <br />transferred to the new lessee that will remain American Soda, L. L. P.'s responsibility to <br />reclaim.
