Cattany <br />2717 County Road 215 Division Director <br />Parachute, CO 81635 Natural Resource Trustee <br />RE: Yankee Gulch Minerals Project, Permit No. M-1999-002, Amendment No. 1 (AM-01) Preliminary <br />Adequacy Review -? <br />Dear Mr. Wilson: <br />The Division of Reclamation Mining and Safety received your March 11, 2008 application for <br />Amendment No. 1 to the Yankee Gulch Minerals Project, Permit No. M-1999-002, addressing a change <br />of post mining land use to industrial commercial for 26.1 acres of the permit area including the <br />processing plant location and surrounding areas. This application cannot be approved until the following <br />issues are adequately addressed. Please submit a response to the following issues as soon as possible, <br />but no later than June 5, 2008 so the decision due date set for June 9, 2008 can be met. If your response <br />or a written extension request are not received by June 5, 2008 this application may be denied <br />ADEQUACY COMMENTS <br />1. Please provide maps in compliance with the requirements of Rule 6.2 and ensure the exact <br />boundaries of the area requested for a post-mining land use (PMLU) change are shown as well as <br />all mining related disturbance, features, structures, etc. <br />2. The BLM lease for this area indicates that reclamation responsibility for the paved access road <br />from County Road 5 to the plant area has been transferred from American Soda, L.L.P. It would <br />appear that the access road will remain in place for the gas plant access. Please clarify if this <br />access road is also to be included in this request for a change of PMLU. If the road is to be <br />included in this request for change of PMLU, an amendment to this application will need to be <br />filed, per rule 1.8, which will require re-publication and re-mailing of the application notice, and <br />will reset the applicable deadlines and review timeframe. <br />3. If the access road has been transferred to another lessee by BLM, please revise Exhibit N to <br />provide documentation that American Soda L.L.P. retains the right to utilize that road to access <br />the mine site. <br />4.
