Cattany <br />Grand Junction <br />CO 81506-3904 Division Director <br />, Natural Resource Trustee <br />Re: Terror Creek Loadout (Permit No. C-1983-059) <br />Permit Renewal Application No. 5 (RN-5) <br />Dear Sir or Madam: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on January 20, 2008, an application to renew an <br />existing permit for another five year term to conduct coal loading operations at the Terror Creek Loadout was <br />considered complete for the purposes of filing. All review and comment periods as provided in the Colorado <br />Surface Mining Reclamation Act and the Rules initiate from this date of filing. Unfortunately, I did not send to you <br />or to the Office of Surface Mining a completeness letter at the time of completeness. I apologize for this <br />inconvenience. <br />The permit area is on land located 4 miles Northeast of Paonia, Colorado and is further described as follows: <br />Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie <br />No additional surface disturbance is proposed as a result of this revision application. As a result, the Division does <br />not anticipate additional impacts to wildlife. <br />The applicant is required to publish notice in the Delta County Independent that this permit renewal application <br />has been deemed complete. At the time of publication of this notice, the applicant is additionally required to place <br />a copy of this application at the Delta County Clerk and Recorder, 501 Palmer Street, Delta, CO 81416, and at the <br />Division office.
