Cattany Grand Junction CO 81506-3904 Division Director , Natural Resource Trustee Re: Terror Creek Loadout (Permit No. C-1983-059) Permit Renewal Application No. 5 (RN-5) Dear Sir or Madam: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on January 20, 2008, an application to renew an existing permit for another five year term to conduct coal loading operations at the Terror Creek Loadout was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. Unfortunately, I did not send to you or to the Office of Surface Mining a completeness letter at the time of completeness. I apologize for this inconvenience. The permit area is on land located 4 miles Northeast of Paonia, Colorado and is further described as follows: Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie No additional surface disturbance is proposed as a result of this revision application. As a result, the Division does not anticipate additional impacts to wildlife. The applicant is required to publish notice in the Delta County Independent that this permit renewal application has been deemed complete. At the time of publication of this notice, the applicant is additionally required to place a copy of this application at the Delta County Clerk and Recorder, 501 Palmer Street, Delta, CO 81416, and at the Division office.
