Z- . <br />This letter constitutes notice that the Costilla County ComT~ittce for 1/nvironme.n,tal <br />Soundness (CES) objects to the proposed Permit Arxaendment 3, DRMS 1'crmit No. M-88-1.1,2, filed <br />by Battle Mountain.. Gold on .bccemUer 2007. <br />We <lo not believe that the Ivlined Laud Reclamation Soard has the authority to grant 13attlc <br />.Mountain Gold crater rights to irrigate the property forn~erly kno~~~ as the Shalom Ranch, T11e <br />Mi~RB cannot grant a change of indust~~ial/mining water to agxiculttue use. <br />The CES contests the assertion by Battle Mountain Gold that the West Fit water is now of <br />pre-mining quai.ity. We fear contazxzination of the fat~mland, which is adjacent to the school anti tl,e <br />Town of San Luis. <br />Further, the Committee for Fnvironn~tental Snurzdness objects to: <br />l . A proposal to close the vfatcr treatment facility located near the Rito Scco Creek on the Battle <br />Mountain Gold (BMG) property. <br />2. A proposal to irrigate tlae BMG property, formerly known. as the Shalom lZanch, with water <br />that should have been prvicesscd through the water treatment plant which is cuz•~•ently .ir7. <br />operation. <br />3. Any proposed changes that may be .harmful to or negatively .impact the citizens of Costilla <br />County, cspecia.lly the town of San Luis. <br />The CES protests that the San Luis community did not receive adequate notice about the <br />proposed arnendtx~ent, as BMRi did not publish tl~.e notice in our local newspapet•s, La Sierra and the <br />Free Press. <br />T'he Costilla County Committee for Environmental Soundness respectfiilly requests that a <br />public hearing be held ]iere in San. Luis instead of Deliver. This wou.id allour an opportunity far <br />adequate input and response from our coni~r~unily.
