Cattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) has reviewed and found the <br />above referenced report to be in compliance with Rule 4.05.13(2). The May 08 Discharge Monitoring <br />Reports were received by the Division on 24 June 2008, the reports cover the time period from 01 May <br />2008 through 31 May 2008. <br />The two NPDES outfalls at the Edna Mine discharged during May 08. DMP 004A and DMP 007A <br />exceeded compliance criteria for the 30-Day Average Effluent Flow. These exceedances are likely due <br />to spring run-off from an above average snowfall. <br />It is noted that based on a Memorandum of Understanding between the Division of Reclamation, <br />Mining and Safety and the Water Quality Control Division (WQCD), the WQCD will be responsible <br />for enforcing CDPS permit conditions including effluent limitations. Kelly Morgan of WQCD <br />acknowledged the effluent flow exceedances for the May 2008 DMRs and any future enforcement <br />actions will be forwarded to the Division. <br />Thank you for the timely submittal. <br />If you have any questions feel free to contact me.
