Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Vegetation Sampling, Trinidad Basin Mine, # C-81-048 <br />Dear Mr. Kromhout: <br />The Division of Reclamation, Mining, and Safety is in the process of terminating <br />jurisdiction over the Trinidad Basin Coal Mine located in Las Animas County Colorado. <br />County records show that you are an owner of the majority of land in the E 1/2 of Section <br />22 T31 S R65 W. <br />As part of the process of terminating jurisdiction, we routinely conduct vegetation <br />sampling on the reclaimed lands associated with former coal mines for the last two years <br />of the revegetation period. This sampling consists of a party of approximately four staff <br />members sampling the vegetation species, composition, and herbaceous production along <br />randomly located transects of about 50 meters in length on the reclaimed area. It results <br />in no disturbance to the land surface. About 30 transects are required to be collected. <br />These data are then used to represent the revegetation success in the written findings that <br />we are required to make as part of the process. <br />We are respectfully requesting your permission to conduct this sampling the week of <br />June 23, 2008 on portions of your property. We also would like to request vehicle access <br />along the road to the southern portion of Section. 22 through recently established gates. <br />This area is fairly remote and vehicle access allows transportation of people and <br />equipment along with a safe place should afternoon thunderstorms occur. We have also <br />spoken with a neighbor, Mr. Oberle, who also owns a portion of the reclaimed area and <br />may also control access through gates from the county road. <br />I would like to speak with you by phone the week of June 2, 2008.
