DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Mr. Jeffrey A. Clark
V Bishop-Brogden Associates, Inc.
V 333 West Hampden Avenue, Suite 1050
Englewood, Colorado 80110
May 14, 2008 ~/ Bill Ritter, Jr.
Governor
Harris D. Clark: 303-806-8952 Mining and Safety
Dear Mr. Clark:
We have reviewed your letter of January 31, 2005 requesting renewal of the above referenced (/
substitute watP~ ~~ ~^^~~~ ^i~n for an existing sand and grave operation. A revised renewal request was
submitted on March 12, 2008, providing also the additional information requested by this office in a
letter dated February 25, 2008. The required fee for the renewal of this substitute supply plan has been
submitted. The original supply plan was approved on October 2, 2003 and it was most recently
approved in a letter dated October 14, 2004.
The Del Camino Pit is located in Section 32, Township 3 North, Range 67 West of the 6m
P.M. The mining operation ceased in March 2005, thus the only depletion under this plan will be
evaporation from 7.54 acres of water surface area exposed after December 31, 1980. The
anticipated net depletion for this plan is 19.24 acre-feet. According to the information provided, no
water surface was exposed within the reclamation permit boundary prior to January 1, 1981. No
phreatophyte credit has been applied to this plan, however due to partial subirrigation of the
historically irrigated acreage a credit of 0.60 acre-feet of consumptive use of ground water has been
applied. No dewatering is provided or sought under this plan
It should be noted that Ready Mixed Concrete acquired the Del Camino Pit site and the 1.5
shares of the Last Chance Ditch water from Owens Brothers Concrete. A. copy of the stock
certificate was provided to this office on March 12, 2008.
The sources of replacement water to be used for this plan are releases from storage at the
Ready Mixed's Bromley Lakes site, 0.1 shares of the Last Chance Ditch and fully consumable water
from the Saint Vrain and Left Hand Water Conservancy District ("Saint Vrain"). Replacements during
March and April 2008 and previous winter depletions and historical return flow requirements will be
replaced by releases from storage at the Ready Mixed's Bromley Lakes site on the South Platte
River near Brighton. Ready Mixed has approximately 190 acre-feet of water in Erger's Pit storage at
the Bromley Lakes site. Water in the Erger's Pit was decreed for augmentation in case no.
1998CW257. Based on the information provided from September 2007 through February 2008, the
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
www.water.state.co.us
