Dear r. and Mrs. DiRezza:
The above-mentioned site has had one or more problems noted that, according to Division of Reclamation, Mining and
Safety (Division) records have not yet been resolved. According to our records, the following problem(s) was(were) to be
resolved on or before December 1, 2007. Listed below are descriptions and corrective actions for the problem(s). Please
resolve the corrective actions and provide evidence of such resolution on or before May 30, 2008.
Please note that if the corrective action(s) are not properly addressed, and evidence provided to the Division by the date
provided above, the listed problems could be escalated to the level of possible violations and would then be referred to the
Mined Land Reclamation Board for further action.
Permit boundary markers were not posted per Rule 3.1.12 (2) which requires the operator to clearly
mark the boundaries of the affected area with monuments or other markers that are clearly visible and
adequate to delineate such boundaries.
Tamarisk was observed in several sections of the pit.
CORRECTIVE ACTION:
The operator shall clearly mark the permit boundary markers and submit photographic evidence of this
on or before December 1, 2007.
The Operator must either submit a letter to the Division committing the Operator to addressing the
Tamarisk problem during reclamation (while regrading the site), OR create a weed control and
management plan per Rule 3.1.10(6) on or Before December 1, 2007. This plan should be developed in
consultation with the county extension agency, or weed control district office, and should include specific
control measures to be applied, a schedule of when the control measures will be applied, and apost-
spray monitoring plan.
