Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed your 112 permit application and has the following adequacy comments. <br />General: <br />Even though the application was called complete, to facilitate the process, in the future it helps to make sure <br />all Exhibits are properly labeled at the top of the page rather than the bottom of the application, for each <br />exhibit. In doing that lthe sequence of exhibits were miss labeled. Reef to comments for Exhibits "M "thru <br />ā€žSā€ž <br />I) Exhibits "A" THRU "C" Adequate. <br />II) Exhibit "I)" Mining plan 6.4.4 <br />A) The applicant ;states "As part of the reclamation plan the pit floor will be plated with 4"- 6" of reject <br />gravel material from the mining process". Post mining land use is water storage, what is the <br />purpose of gravel placement, when water storage is the final land use for the site ?Please explain. <br />B) Operator did clot provide a detailed design for the slurry wall. A statement by the applicant states " <br />Slurry walls are typically constructed through the excavation of a trench of approximately one yard <br />wide or wider. The applicant/operator will provide detailed designs in the form of a Technical <br />revision at a future date once other permits and approvals are obtained from other agencies'. Please <br />note, the slurry wall design, construction and QA.QC, has to be approved by the Office of State <br />Engineer's Office, with a copy to DBMS. Once the approval is granted by SEO, the operator will <br />have the option of posting the entire cost of the slurry wall, or construct the slurry wall, obtain an <br />approval from SEO and then only post 20% of the total cost of construction for maintenance. <br />C) As part of the mining plan, the applicant plans to move the Excelsior Ditch. Please provide the <br />detailed engineering design for the portion of the ditch that will be relocated. The design has to <br />show, the ditch. to be in dynamic equilibrium, with the existing structure and must handle the <br />maximum anticipated flow with adequate free board. 'The applicant did not include a notarized <br />agreement with the ditch owners that will allow them to make the change in location. Please <br />provide a notarized agreement as required in the Rule. The only thing that was provided with the <br />application wa;~ a statement from the applicant" The operator has agreement with the Excelsior <br />Ditch Co. to relocate the ditch to the North of the proposed mining area. The ditch will be <br />trapezoidal in shape being approximately 15 feet wide". <br />D) Applicant plan:> to place several buried water line delivery systems as part of the water resources <br />reclamation plan. Please provide the detailed design, and location of these proposed buried pipe <br />lines.
