Olathe Pit 110 Operation <br />MLR No. M-84-108 <br />Dear Wally: <br />Enclosed is the Annual Report for the past year for The Olathe Pit of Western Gravel, <br />Inc., including map and report form. Past records show that the annual date for the pit <br />is December 14 of each year. The financial warranty for the permit is $8,167, and the <br />total permit area is 9.9 acres. <br />The following information is provided to comply with Rule 2.4.1: <br />This permit was issued in 1984 and the previous operator, S&W, sold the property to <br />Western Gravel in early 2000. Western Gravel assumed the permit at that time. At that <br />time, the north pond, which was mined in 1985, was completely reclaimed. It is my <br />understanding that since this pond was created before the river was designated to be <br />over-appropriated, it is exempt from the water right law. Western Gravel, Inc. continued <br />mining on the southern side of the permit area (south pond) and asked Greg Lewicki <br />and Associates in 2003 to look at making an Amendment to the permit to add <br />additional mining area since the entire property is over 45 acres. As we looked at doing <br />this, we reviewed the water rights status and found that the water rights that came with <br />the property were 1) not converted to industrial use and 2) they could not be converted <br />
