Richartl D. Lamm
Governor
III IIIIIIIIIIIIIIII
999
DEPARTMENT OF NATURAL RESOURCES
David H. Gelches, Executive Director
MINED LAND RECLAMATION DI\
DAVID C. SHELTO N, Dlrettor
DATE: September 11, 1985
T0: Susan Mowry \ (~~
FROM: Jim Pendleton ~~/..~"T~
RE: West Elk Co omp 's Subsidence
Stipulati S ttal (Permit C-80-007)
Pursuant to your request, I have reviewed the recent submittal made by
Anaconda Minerals on behalf of West Elk Coal Company (WECC), in reference to
stipulation No. 20, placed upon the original Mt. Gunnison No. 1 permit.
Stipulation No. 20 of the original permit refers, among other things, to
requirements for future subsidence evaluation updates to be submitted as
portions of future permit requests and subsidence-related landslide studies to
be performed above the townsite of Somerset, Colorado.
Since the original permit approval, WECC's frequent submission of permit
revision applications has necessitated redrafting of the original permit
documents. Anaconda Minerals may be unaware of the significant renumbering
and redrafting of the original permit stipulations. In the latest decision
document, produced for approval of the 1,630 acre permit revision application,
stipulation No. 21 addresses the topic of subsidence-related landslide
studies. It is important to note that the concern regarding possible
landslide rejuvenation related to areas adjoining Beaver Resevoir, as well as
the area specified in Section 17 above the townsite of Somerset. With this in
mind, and assuming the the amendment of Mt. Gunnison's permit to exclude
mining by WECC within the F Seam in Section 17 is accomplished, I recommend
the following revision to Stipulation No. 21.
STIPULATION N0. 21
THE DIVISION DIRECTS WECC TO COMPLETE A DETAILED ANALYSIS OF THE POTENTIAL
EFFECTS UPON THE SLOPE STABILITY OF THE LANDSLIDE DEPOSITS ADJOINING BEAVER
RESEVOIR. WECC SHALL INSTALL AND MONITOR AN APPROPRIATE SET OF MONUMENTS ON
THE LANDSLIDE DEPOSITS, IN ORDER TO OBSERVE THE POTENTIAL DISPLACEMENT OF THE
LANDFORM. THE DETAILED ANALYSIS SHALL BE COMPLETED AND SUBMITTED TO THE
DIVISION FOR REVIEW, PRIOR TO REQUEST FOR APPROVAL TO EXTRACT COAL BENEATH THE
LANDSLIDE DEPOSITS ADJOINING BEAVER RESEVOIR.
In the recently amended findings for the 1,630 acre permit revision,
Stipulation No. 22 addresses the future revision of the Mt. Gunnison No. 1
subsidence evaluation. .In response to Anaconda Minerals request, I believe it
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
