The Division has several questions and comments related to <br />the report. <br />East Yard <br />The Division commends Oxbow Mining, LLC for their continued reclamation of the <br />East Yard disposal area. The Division would like to remind OMLLC that, pursuant <br />to Rule 4.10.2(2)(a), upon completion of final reclamation of the pile, quarterly <br />inspections could be terminated. It appears as though there is only a small portion of <br />the pile that needs to be covered, topsoiled and seeded. The Division would <br />encourage OMLLC to complete the reclamation of the East Yard disposal area so <br />inspections can be terminated and the bond release process can be initiated. <br />2. The report states that approximately 75% of the top of the East Yazd disposal area <br />has been covered. [t is the Division's impression that this percentage may be low. <br />Please verify that 75% is correct or amend the report as necessary. <br />West Vallev Fill <br />Permit page 2.05-47 states that quarterly inspection reports will include the "quantity <br />and location of any refuse placed in or removed from the pile." It was noted in the 13 <br />September 2005 and 25 October 2005 Division inspection reports that refuse has <br />been placed on the pile and needs to be spread and compacted. It was also noted in <br />the 23 August 2005 Division inspection report that refuse had been removed from the <br />pile (and hauled to the Bowie No. 2 Mine wash plant). In keeping with the <br />commitment in the OMLLC permit, please amend the coal mine waste disposal piles <br />inspection report and include the quantities of the above referenced additions to and <br />removals from the pile as well as any additional additions to and removals from the <br />pile in the third quarter.
