Section 25-8-501(1) of the Water <br />Quality Control Ad requires that a permit be obtained for discharges into state waters. Inspections by both <br />the Division of Minerals and Geology and this Division on two separate occasions have revealed that a <br />discharge pemlit is necessary. Therefore, the Division is requesting that the attached permit application be <br />completed and submitted within sixty days of receipt of this letter as required in Part 6.5.1(1) of the <br />Regulations for the Discharge Pemrit System. Failure to apply for and obtain coverage under the necessary <br />permit(s) may result in enforcement action by this Division. Such enforcemem action carries a civil penalty <br />of up to S 10,000 per day. <br />Should you feel that a permit is not requ'ved, please submit your explanation to support this determination <br />along with the completed application.
