"Rocky Ford East Pit", Otero County <br />File No.: 77-560 <br />Dear Mr. Jobe: <br />The Annual Fee and Report for the "Rocky Ford East Pit" was received by the <br />Division on March 4, 1985. <br />After reviewing the 77-560 file, I realized that revegetation has not <br />occurred. The Reclamation Plan (Exhibit E) included in the Permit Application <br />states: <br />"There will be five mining stages, each followed by a <br />five-year reclamation phase. Valco plans to attempt to <br />complete refill, grading, and revegetation within one year of <br />completion of each mining stage. The only variation will be <br />when the operator is required to delay planting to await <br />favorable seasonal conditions. The remaining four years of <br />each reclamation phase will be devoted to monitoring <br />revegetation efforts and performing remedial work where <br />necessary." <br />The reclamation costs and, subsequently, the Financial Warranty, were <br />calculated using a "phased" reclamation schedule. Total reclamation phasing <br />has not occurred to date. Please explain the deviation from the Reclamation <br />Plan, and measures planned to adhere to the proposed commitment; or, revised <br />Reclamation costs for total, as opposed to phased, reclamation efforts. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
