The Division has reviewed New Elk Mine's 1999 Annual Reclamation Repoli. A summary ofthe report
and rey uirentents of the submittal in accordance with Rule 2.04.13(1) follows:

The form the operator included with the New Elk Mine Annual Reclamation Report is unclear on
[he number of acres disturbed in 1999. The operator reports 145 acres disturbed, but Ids acres is
[he total of {Ong teen disturbance of [his mine. The New Elk Mine had been in Temporary
Cessation status during 1999. The Division believes that the operator intended to report [ha[ no
new acres were disturbed in 1999.

Picketwire Processing, Inc. (PPI) reports that 11.5 acres were backfilled and graded in 1999.
Since [his is [he total backfilled and graded acres for the entire site, [fte Division suspects that the
operator backfi I led and graded the 2.0 acres on RDA bench 4. Please have the operator correct
the number of acres backfilled and graded in 1999.
d) Locution and number noes topsoiled during rho! year.
Based on the 1999 ARR report, PPl indicates that 1 I.5 acres were topsoiled in 1999. Eleven and
one half acres represents the total acreage that Picketwire Processing has topsoiled over the entire
site. Please have PPI report that portion that was topsoiled in 1999.

Picketwire Processing, Inc. seeded 2.00 acres of RDA bench 4 in 1999. The report does no[
indicate which seed ritix was planted. Please have PPI indicate seed ntix and seeding rate used.
