Lamm <br />Governor <br />M E M O R A N D U M <br />8~ovember 1983 ' <br />T0: Ed Bischoff <br />,\~ '~ <br />FROM: Jim Pendleton ' <br />RE: Subsidence Geot ica Findings for Eagle No. 9 Mine - <br />P it ision Application <br />Completeness: <br />My review of the subsidence aspects of Empire Energy Corporation's permit <br />revision application for the Eagle No. 9 Mine has determined that the <br />application is geotechnically complete. <br />Adequacy: <br />The applicant has responded to many of the deficiencies discussed in our <br />August, 1983 findings document for the Eagle 140. 5 & No. 9 Mines. The <br />information included within the revision application is sufficient to <br />allow approval of mining within the No. 9 Mine. Several items remain <br />unresolved, necessitating stipulation within the findings document for <br />the revision: <br />(1) The applicant should complete amendment of snap IV-3 to clearly <br />depict the location of the private residence located within the NE <br />quarter of the SE quarter of Section 30 of T6N, R91'd, and to <br />clearly define the proposed limits of planned limited Extraction. <br />(2} The applicant has failed to amend their monitoring proposals to <br />include monitoring of all Empire Village structures and the private <br />residence referenced in (1), above. This was required by original <br />Stipulation No. 21, which will have to remain in force. <br />(3) The applicant has not submitted an amended subsidence report <br />format, as required by original Stipulation No. 22, which will have <br />to remain in force. <br />(4) The applicant has not submitted a visual monitoring program fur <br />State Highway 13 or County Road 107, as required by original <br />Stipulation Wo. 24, which will have to remain in force. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
