Thompson
Project Engineer
Subject: Refuse Disposal Area
New Elk Mine
Las Animas County, Colorado
Job No. 20,122
'J IVIOiJII J: ;v1h lCI UIJ .k ~c~ll,yv
Basin Resources received a Notice of Violation No. NOV C-93-060 for the New Elk Mine,
Refuse Disposal Area {RDA) based upon inspections completed by the State of Colorado,
Mined Land Reclamation Division (MLRD) April 12 through 16, 1993. In the Schedule to
Notice of Violation, the State identified four steps necessary to abate the violation
(remedial action), including:
A. Drain water from standing water pond by pump into pond 008.
B. Drain water as much as physically possible from the low areas at the top
of the pile by installing dewatering ditches that drain toward the west
"Reno Mattress" ditch on the front of the pile, leading to pond 008.
C. Provide, per 4.09.1(11)a, a certified report by a qualified registered
engineer that, in addition to requirements of 4.09.1(11), describes whether
the dirt and rock material being added to the pile is allowable under the
approved plan.
D. If the material is not allowable, then remove it from the pile.
In a meeting held May 3, 1993 at MLRD we were requested to complete the report
identified in item C above and to provide our opinion of the acceptability of "dirt and rock"
which has been incorporated into the pile from a geotechnical perspective. This letter
describes the scope of work completed as part of our subsequent evaluation and
presents our opinion whether the RDA is being constructed in substantial accordance
with the approved mine plan.
1571 WEST 12TH Av ENUE DENVER, COLORAD08020~ (303)8250777
