("OMI") is aware that Mountain Coal Company, LLC's <br />("MCC") permit boundary north of the North Fork of the Gunnison River overlaps <br />with OMI's south property and permit boundaries in Sections 9 & 10, T13S, <br />R90W, 6"' P.M. It appears that this boundary also overlaps with the Union <br />Pacific Railroad and Colorado Department of Transportation's old and new <br />Highway 133 rights-of-way in this location. Being that MCC's north permit <br />boundary generally coincides with the public highway right-of-way and railroad <br />right-of-way (leased by MCC and OMI), MCC's right to enter these lands is for <br />the most part provided by these rights-of-way.
