It was subrrtitted timely, anEl is comprehensive. However, please address the following items_ Item 1. References to Exhibits in the report are out of synchroriization. In the report cover letter [Colowyo Coal Company, L.P. (Colowyo)] letter of Mazch 28, 2002, page 2, Streeter Fill reports aze cited as at Exhibit 7. They were found in Exhibit 9, Exhibit 7 being a map. West Pit Fi11 reports are included as Exhibit 10. The report letter cites Exhibit 8: Section '16 reports are included as Exhibit 11. The report letter cites Exhibit 9. Reports on sampling of overburden are at Exhibit 12. The report letter cites Exhibit 10. Reports on revegetation monitoring aze at Exhibit 13. The report letter cites Exhibit 11. Please reconcile the references. Item 2. The Permit (page 2.05-57) requires a random sampling of topsoil. None were reported, nor did I find where any have been reported as far back as 1994 (ARR). Please address this issue in a future revision to the Permit Application Package. Item 3.OnIy cross-section 1-1' ofthree cross~ections (Exlubit 8) encounters an area of2001 reclamation. To validate backfill to approved post-mining topography (Map 19) in other areas, the (staff) Division of Minerals and Geology (Division) attempted to compaze the information on Map 19 to that of Exhibit 7. The Division understands that the topographic lines (light gray) on Exhibit 7 are those as of 10/04/01. If this is not so, please advise. In this regard, there aze unconnected light black lines superimposed over the light gray lines in the area of the 21.7 acres of 2001 reclamation near the eastern edge of East Pit reclamation. As this is an azea reported as to final grade, please reconcile the topographic lines in this area. (The Division recognizes the 10/04/01 flight information and the 3/18/02 compilation of Exhibit 7.) Across-section (similaz to 1-1') through the center of this azea from WNW to ESE would be helpful in demonstrating the degree that backfilling approaches approved post-mining topography.
