Long <br />Division DueUO~ <br />RE: Foidel Creek Mine Subsidence, Twentymile Coal Co., #C-82-056 <br />Dear Mr. Gabos: <br />As you are aware, the Twentymile Coal operation at the Foidel Creek <br />mine has and is currently causing subsidence of the Twentymile <br />Sandstone cliff and Routt County Road #27 within their approved <br />permit area. Based on our discussion on June 21, 1994, Twentymile <br />Coal representatives have been in close contact with the county <br />with regard to these activities. You also indicated that you, or <br />a member of your staff, has visited the site, in particular to view <br />the subsidence impacts to the cliff above the county road. Our <br />understanding is that the county felt the roadway below the current <br />area of subsidence damage was not in danger of rockfall due to the <br />some 1300 feet distance between the cliff and the county road. <br />That is presently the Divisions assessment as well. <br />The Division of Minerals and Geology (DMG) regulates the mining of <br />coal in Colorado through the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board pursuant to the Colorado Surface Coal <br />Mining Reclamation Act. The mitigation of subsidence damages and <br />the protection of the public health and safety are specifically <br />regulated by these Rules. However, visual impact is not an area <br />that is regulated under the Rules at this time. Possibly Routt <br />County, through the Special Use Permitting process, has regulations <br />which would cover visual impacts. If so, it is our current <br />understanding that possible future concerns over visual impacts <br />would be handled via this process. Although the Division has not <br />received any public comment concerning the visual impact to the <br />Twentymile Sandstone cliff, we feel it is appropriate to bring this <br />issue to your attention, should it arise in the future. Currently <br />approved mine plans have the potential to damage more of this cliff <br />outcrop, assuming the recent activity is any indication of what is <br />to come. <br />
