As we have discussed during telephone conversations recently, the Division is still awaiting
receipt of Cyprus Empire's semi-annual subsidence report covering January 1993 -June 1993
for the Eagle Mines. As per Rule 2.05.6(6)(c)(i)(D) Subsidence monitoring shall be
performed at least quarterly. Rule 2.05.6(6)(c)(i)(E) states that results shall be submitted
to the Division at least semi-annually. Additionally, the Eagle Mine permit commits to
submittal of the subsidence monitoring reports at least semi-annually, permit page
The most current subsidence monitoring report the Division has received for the Eagle Mine
covers the period from July 1992 -December 1992. This report was received on February
12, 1993. This was the only subsidence report for the Eagle Mine received in 1993.
Reviewing previous subsidence report submittals indicates that Cyprus Empire customarily
submitted the reports within 60 days from the completion of the time period the report
covers. The Division considers this a reasonable amount of time to pre;~are and submit the
reports.
You have informed me that the data has been collected for the first 6 months of 1993 and
the delay involves compilation of the report. In light of the time period elapsed the Division
shall require submittal of the subsidence monitoring report covering January 1993 -June
1993 by January 21, 1993. This date corresponds with our planned meeting in Denver
regarding the Okie Plaza well. Failure to submit the required subsidenc;e report by January
21, 1993 will result in a violation of Rule 2.05.6(6)(c)(i)(E).
In order to alleviate any confusion of when these reports need be submitted, the Division
feels that a requirement of submittal within 60 days of the end of the time period the report
covers is ample time for Cyprus Empire Corp. to comply with Rule 2.O.i.6(6)(c)(i)(E). For
clarity, the report covering July 1993 -December 1993 should be received by the Division
