As a <br />result, the ARRs for 2003, 2004 and 2005 were revised and copies of these revisions are <br />enclosed. <br />Revisions to previous ARRs are to a great extent the result of two factors: 1). The Division <br />has digitized the various disturbance azeas at the New Elk and this provides more accurate <br />data then the planimetered acreage previously reported. 2). The 2003 acres reported as <br />topsoiled included acreage not required to receive topsoil. Principally, these were pre-law <br />azeas classified as DNR (Disturbed No Refuse) that were not bonded to cover the cost of <br />topsoil placement. However, the operator chose to topsoil these areas to improve the the <br />success of revegetation in these azeas. This was soil like material recovered during <br />recontouing the road between the coal lab and the rail maintenance building and not soil <br />dedicated to future reclamation at the mine. <br />Enclosed with the 2003 ARR are invoices for seed and fertilizer used at New Elk during 2003. <br />Additional seed was purchased later in 2003. Granite Seed will provide copies of these <br />invoices to New Elk and will be forwazded to the Division. The seed tag for 2005 is enclosed <br />with the 2005 ARR and the packing slip and seed certification are enclosed with the 2006 <br />report. <br />
