The reports <br />indicated that the sites have been, and may continue to be, inactive for at least <br />six months. Please refer to the Minerals Rules and Regulations Sections 1.6.2 and <br />1.6.2(2)(a) which state that if an operation ceases production fora period of <br />180 days or more, the operator must file a Notice of Temporary Cessation with the <br />Board. This notice must state the date of cessation, the reasons for cessation, a <br />plan for the resumption of mining, a aescription of those activities the operator <br />will take to ensure compliance with the permit reclamation requirements and a <br />description of site maintenance activities to ensure compliance with the <br />performance standards (Rule 6), The Notice of Temporary Cessation should be sent <br />to the Division separate from other correspondence. <br />As an alternative to temporary cessatioh, you may wish to amend these permits to <br />indicate these operations will be intermittently active throughout their life. The <br />amendment application must include a description of those activities the operator <br />will undertake to ensure compliance with the permit reclamation requirements, and a <br />aescription of the site maintenance activities which will ensure compliance with <br />the performance standards (Rule 6). Rule 1.6.2(2)(d) addresses this amendment. <br />Since the annual reports indicates that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a permit amendment within <br />the next 45 days. If the request indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation within sixty days. If the <br />request indicates that there may be some problems with the site, we will either <br />request more information from you, or schedule the site for an inspection. If you <br />submit an amendment to the permit, we will process it within 30 to 90 days for 110 <br />and ]12 operations, respectively. <br />If you have questions, please do not hesitate to call. <br />Sincerely, <br />Barbara D.
