Rink
Aquacic and Wetland Consultants
..-:glut Eleven Bu? ~~~^^
1911 11th Street, Suite 301
Boulder, Colorado 80302
Dear Ms. Rink:
Reference is made to your September 19, 1987 letter which concerns the
_ final wetland map for the Dowe Flats property located at Sections 9, 10, 15,
and 16, T-3-N, R-70-W, Boulder, Colorado.
During our September 11, 1987 site visit, it was determined that the wetlands
found in this area, as shown on your map, are under the Corps of Engineers'
regulatory jurisdiction pursuant to Section 404 of the Clean Water Act.
As noted on the enclosed exerpt from your wetland map the marked channel
is also considered waters of the U.S. under the Corps jurisdiction. As
previously discussed the water flowing within this channel may be diverted, in
the future, through an existing non-fuctional drain tube at this site. This
activity will not envolve the discharge of dredged or fill material into
waters of the U.S. Therefore, a Department of the Army permit will not be
required. In that case this portion of wetland channel may cease to exist
as waters of the U.S. and therefore no longer be under the Corps jurisdiction.
Sincerely,
TERRY IICFEE
Environmental Resource Specialist
J
