Banta. <br />Drvis~on Director <br />Re: Permit File No. M-79-187 Clayton-Murphy Pit, Annual Fee and Report <br />Request, Notice of Violation <br />TO WHOM IT MAY CONCERN: <br />• <br />The Mined Land Reclamation Act and Permit No. M-79-187 require you to submit <br />$350.00 in annual fees and an annual report on or before January 23 of each <br />year. We have not received the annual fees and report. Therefore, a <br />violation exists to Permit No. M-79-187- and a civil penalty has been <br />assessed in the amount of $350.00, due and payable within 30 days of the date <br />of this letter. If the annual fees, annual report and the civil penalties <br />have not been submitted within 30 days of this notice, March 5, 1990, this <br />permit will be scheduled for Formal Public Hearing before the Mined Land <br />Reclamation Board for consideration of permit revocation and forfeiture of the <br />$10,000.00 financial warranty at the March Board Meetinc. <br />The March Board Meeting will be held on March 21 and 22, 1990, in Room 220 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m, or as soon <br />thereafter as the matter can be considered and you will have the oppcrtunity <br />to be represented and heard. <br />TO AVOID THE ABOVE ACTIONS, PLEASE SUBMIT $350.00 FOR ANNUAL FEES, $350.00 FOR <br />CIVIL PENALTIES AND YOUR ANNUAL REPORT BY MARCH 5, 1990. <br />If you have any questions please contact Barbara Chiappone. <br />Sincerely, <br />~_;~ ~~~ <br />FRED R.
