Enclosed please find the following items: 1 ) A copy of letter of credit no.
83-15 from the Bank of Applewood; 2) A copy of the cancellation notice for
'3 that letter of credit, also from the Bank of Applewood; 3) A copy of the
j legal description of the permit area for the Douglas Pit (to be attached to
any form of financial warranty submitted); 4) A irrevocable letter of
y credit form to be used by any bank submitting a letter of credit for your
company in the future and a financial warranty - letter of credit to be
paired with that letter of credit; and 5) A financial warranty document to
! be paired with a certificate of deposit made out to "State of Colorado -
Mined Land Reclamation Board" and the interest to go to you or your company.
I These items should allow you to replace the cancelled letter of credit with
;j another form of financial warranty as soon as possible.
As we discussed in today's telephone conversation, the form of the cancelled
letter of credit allows it to be cancelled without the notice period man-
dated by our standard form. Such a form of a letter of credit is not usually
accepted by us for just that reason. Technically, the cancellation of the
letter of credit means that the Board could find you to be in violation of
the permit for this operation for failure to maintain the financial warranty
in good order. Therefore, it is imperative that a new financial warranty
be submitted as soon as possible. The performance warranty cannot be
cancelled and remains in our possession. It does not need to be replaced.
As I mentioned, on November 8th each year (the anniversary date of permit no.
83-89), an annual fee of $50.00 and an annual report on the progress of
mining and reclamation on the site of the Douglas Pit are due to be submitted
to us . Please also submit these items at your earliest convenience.
I am pleased that we are in agreement that both the matter of the new
financial warranty and the overdue fee and report should be corrected as
soon as possible. Now that we have the correct new address for your company,
these matters can be rapidly corrected. However, as I mentioned to you,
if the new financial warranty and the fee and report do not come in fairly
soon, I will have to place the matter on the January 23-24, 1985 agenda for
the monthly meeting of the Mined Land Reclamation Board. If we have not
