Since the Division has required compaction tests by <br />Stipulation No. 16 to the Permit, we have had difficulty receiving <br />the reports within the 2 weeks specified by Rule 4.09.1(11)(b). <br />The material consistently passes the compaction tests, and the <br />stability of the pile has been ensured on the basis of the testing <br />done to date. It is my professional opinion the tests are not <br />necessary to evaluate the potential hazard to human life and <br />property, and that proper construction and maintenance are <br />occurring, pursuant to Rule 4.10.2(2)(b), as specified in <br />Stipulation No. 16 to the Permit. <br />Oxbow Carbon and Minerals, Inc. requests the Division to recognize <br />that Stipulation No. 16 has been complied with, and that further <br />compaction testing is not necessary, thereby terminating <br />Stipulation No. 16. <br />Sincerely///~~ <br />Thomas C.
