Ca"any <br />~ Division Director <br />subject: Review of 2"d Quarter 2004 Inspection Report, Foidel Creek Mine, C-198~~6esnnr<e Trustee <br />date: July 22, 2004 <br />September 22, 2004 (amended) <br />Rule 4.09.1(] 1)(a) The fill shall be inspected for stability by a registered engineer or other <br />qualified professional specialist experienced in construction of earth and rockfrll embankments <br />under the direction of a qualified professional engineer at least quarterly throughout the <br />construction and during the following critical construction periods: (1)removal of all organic <br />material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage <br />systems, (4) placement and compaction of fill materials, and (5) revegetation. <br />The subject inspection was a quarterly inspection accomplished throughout construction, not one <br />of the critical construction periods. The report does not specifically state that a registered <br />engineer or other qualified professional specialist made the inspection, but infers such by <br />certification or the report. <br />Rule 4.09.1(11)(b) The qualified registered engineer shall provide to the Division a certified <br />report within 2 weeks after each inspection that the fill has been constructed as specified in the <br />design approved by the Division. The report shall include a description of any appearances of <br />instability, structural weakness, and other hazardous conditions observed during the inspection. <br />A copy of the report shall be retained at the mine site. <br />The site was inspected on June 29, 2004. The report was thus due at the Division on July 13, <br />2004. It was received at the Division of Minerals and Geology (Division) on July 12, 2004. The <br />report was timely. <br />Appearances of instability, structural weakness and other hazardous conditions were not related <br />in the report. The omission was brought to the attention of the operator as an adequacy item. <br />These deficiencies were corrected in an amended report of September 14, 2004. <br />Rule 4.09.1(1 ])(c) See the rules for the text of this rule. This rule applies to photographs of <br />underdrains.
