III IIIIIIIIIIIIIIII <br />999 <br />PACIFIC BASIN RESOURCES <br />A Division of Oxbow Carbon & Minerals, Inc. <br />ROAD CERTIFICATION <br />Revised Rules and Regulations, Colorado Mined Land Reclamation <br />Board for Coal Mining, Effective August 1, 1995, Implementation <br />Information, Item 4. states "Amended Rule 4.03.1(1)(d) and new <br />rule 4.03.2(1)(f) now require construction certifications, by a <br />qualified registered professional engineer, of all constructed or <br />reconstructed haul roads and access roads not within disturbed <br />areas. The Division will formulate a policy or guidance for <br />operators in regard to certifying previously constructed roads <br />which may have been built before SMCRA or not under the guidance <br />of a professional engineer. Certifications for all other haul <br />and access roads, for which a current certification does not <br />exist, must be received by the Division prior to October 15, <br />1995." <br />Previous rules required certification for haul roads when <br />requested by the Division for good cause shown, and did not <br />require certification of access roads. Most of the roads for the <br />Somerset and Sanborn Creek Mines were constructed before SMCRA. <br />By agreement with Anthony J. Waldron, Environmental Protection <br />Specialist, Colorado Division of Minerals and Geology on <br />September 22, 1995, I certify that all roads relating to the <br />Sanborn Creek Mine were constructed to the specifications in <br />effect at the time of construction to the best of my knowledge <br />and belief.
