SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br /> SUBJECT: VARRA COMPANIES, INC , # 74-52 , WELD COUNTY, RESPONSES <br /> TO OUR COMMENTS TO THEIR APPLICATION FOR MINING AND <br /> RECLAMATION PERMIT <br /> As requested by your office, we have reviewed the above referenced responses <br /> to our previous comments regarding a gravel pit 6 miles north of Firestone <br /> along St. Wain Creek. We still have the following concerns that we <br /> would like the applicant to either respond to or acknowledge: <br /> 1 . If the water court approves the proposed change in use of the <br /> existing decree owned by the applicant there would appear to <br /> be a sufficient amount of water available to offset the <br /> evaporation losses of the existing exposed water surface areas. <br /> In order to protect the senior water rights from the consumptive <br /> uses associated with the proposed future expansion, the applicant <br /> proposes to submit a plan of augmentation. Assuming 40% <br /> efficiency for flood irrigation,the applicant would have to <br /> acquire an existing decree that historically diverted 320 AF <br /> from Saint Wain Creek. This would equal the historic amount <br /> of water needed to provide 128 AF for crop consumption. In <br /> addition, the applicant must also show that an area previously <br /> irrigated which had an average consumptive use of 128 AF has <br /> been removed from irrigated production. <br /> 2 . The applicant states that he has submitted an application for <br /> an industrial well permit for on-site dust control during the <br /> operation. Since the project is located in an over-appropriated <br /> basin, the applicant will have to include this use in the plan <br /> of augmentation that is being submitted to the Water Court in <br /> order to obtain the well permit. Upon approval of this plan of <br /> augmentation this office will then issue a well permit. <br />
