Banta <br />Division Director <br />RE: 10 January, 1989 Mid-Term Review Issues, and 7 June, 1990 Recommendations <br />and Findings for Denial of Permit Renewal <br />Dear Mr. Hendrix: <br />The 1G January, 1989 adequacy review letter identified 29 issues that needed <br />revisions, nine of which required resolution prior to permit issuance. The <br />7 June, 1990 recommendations and findings identified two additional issues <br />which needed to be resolved prior to the permit renewal. The Division has <br />received the Pioneer Engineering Corporation responses dated 10 August, 1990 <br />and topography maps received 3 October, 1990. <br />The following minor items from the 10 January, 1989 ordinary review letter <br />require revisions prior to the resumption of mining: <br />Items 1, 6, 7, 8, 10, 11 , 12, 13, 11, 18, 19, 20, 21, 22, 23, and 24. <br />The following major issues still need to be resolved prior to permit issuance. <br />* Item 16, Topsoil redistribution schedule. <br />Item 25, Information regarding general status of the operation with <br />respect to facilities construction, phase of pit and fill <br />development. Final topography map (based on the recent air photo <br />survey map)P. <br />I*_•am 28, Certified topographic map indicating permit boundaries and <br />disturbed areas (cross section maps sent in were not certified nor <br />did they have a horizontal scale). <br />Issues from the 1 June, 1990 recommendations and findings: <br />1. Permanent stream channel, diversions, and collection channels <br />associated with the excess spoils disposal area to meet 100-year, <br />24-hour storm event design criteria pursuant to rules 4.09.1(5) and <br />4.09.2(7). <br />2. Demonstration of right of entry pursuant to Rule 2.03.6(1) and <br />section 11U(2)(j) of the Act. <br />3. keplacement bond of $1 ,125,300. <br />
