RE: Instance of incomplete file copy supplied to objectors, Allen Pi t, File No. M-2005-080
The objectors have raised the complaint that the Division did not supply all documents contained in the
official file for the Allen Pit application, File No. M-2006-080. It is Division policy, and Colorado law
pursuant to the Colorado Open Records Act, to supply all documentation related to a permit, with the
exception of confidential materials, to the public upon request.
The objectors' representative received four CDs of imaged documents of this ftle on Apri126, 2006; May
1, 2006; May I7, 2006; and May 23, 2006. The last correspondence related to permit adequacy issues
was imaged into the system on May 10, 2006. Therefore, the electronic file was current as of that date.
According to the objectors' representative, the CDs provided on April 22, May 1 and May 17 were
incomplete. The Division was notified by the objectors' attorney of the missing documents in these CDs
on May 22 and 23• and immediately faxed the materials to the attorney.
Pursuant to Division procedure, the CD produced on May 17, 2006 should have been current and
complete. Therefore, the Division is investigating the allegation that the CDs were incomplete, and is
attempting to obtain copies of these CDs to determine which documents may have been missing. If the
copies supplied to the requesting party were deficient, the Division will evaluate its internal procedures
for making file copies to ensure complete copies of requested files aze supplied in the future.
