Cattany <br />Division Director <br />Natural Resource Trustee <br />DMG received the warranties for the Hocker Gravel Pit on April 25, 2006, approximately 438 days <br />after DMG approved the application. Pursuant to Rule 4.1(2), if warranties are not received within <br />one year of approval of an application, the Board shall hold a hearing, in accordance with the <br />notification and comment provisions of Rule 1.6, to reconsider the previous approval. <br />Therefore, DMG will schedule the issue for consideration by the Board, but prior to the hearing <br />the permit holder must satisfy all notice requirements of Rule 1.6.2 and 1.6.5, as indicated by <br />Rule 4.1(2) and Section 24-4-105(1) and (2) of the Administration Procedures Act (APA). Prior to <br />the reconsideration hearing-the permit holder must re-notice the Board of County Commissioners, <br />Board of Supervisors of the local soil conservation district, current surface and mineral owners of <br />the affected land, current surface owners within 200 feet of affected lands, the public by four <br />weeks of publication in a local newspaper, re-post the notice required by Rule 1.6.2(1)(b), and <br />provide copy of the application to the county Clerk or Recorder.
