COLORADO 80001
October 26, 1977
Colorado Department of Natural Resources
Mined Land Reclamation Board
1313 Sherman Street
Denver, Colorado 80203
Attention: James L. Schmieding
Reclamation Specialist
Re: Christian Pit Permit
File No. 74-111
Dear Jim:
We are requesting that our permit for the Christian Pit located southwest of
Fountain, Colorado in E1 Paso County be reviewed with a reduction of the area
involved and also a reduction in the bond requirement.
I previously talked to Rade Orell concerning this and have made an inspection
with him of our operation but since he is transferring Jurisdiction of this
particular area to you, we would appreciate your inspection and review.
This pit permit was applied for in 1974 and granted under the 1973 Act and will
expire June 30, 1979. Since we are requesting the changes in acreage involved
and bond requirement, it may possibly be better to convert the permit to a "Life
of the Mine Permit" under the 1976 Act.
I believe there is some confusion about the actual area and the bond requirement
because we originally requested 160 acres and the board approved only 40 acres at
their December 16, 1974 meeting. However, the normal price per acre set for
reclamation at that time was $750.00 per acre and the bond requirement for 40 acres
should have been $30,000.00 instead of $120,000.00 which we now have posted.
I have submitted a map to Rade Orell showing the area excavated since December 1974
to be 15.2 acres, more or less. In case we convert to the 1976 Act we would like
to make the permit for 30 acres including the 15.2 acres already excavated.
For your information this gravel lease has been operated by Schmidt since 1967 and
during that period we have stripped the topsoil and replaced over approximately
200 acres. We did not reseed this area because the land owner didn't feel it worth
