Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology received your comments on the above referenced 1 I Oc <br />application. The applicant in response to staff's adequacy review has addressed the following concerns <br />noted in your letter. <br />1) The Division accepts the overburden and topsoil placement within the permit boundaries is <br />conceptual for any new operation. Details as to the size of these stockpiles should be reflected in <br />Annual Reports. The applicant has committed to seeding overburden and topsoil berms with an <br />approved seed mix if they remain in place for more than 1 growing season. <br />2) Topsoil amounts are estimated to be between 0 and 12 inches by staff and the NRCS. The <br />Reclamation Plan per NRCS recommendations calls for placement of approximately 6 inches of <br />soils back on the site. The applicant has committed to 6 inches of topsoil placement and the <br />reclamation bond calculated accordingly. <br />3) The plan notes site berms, which are to be constructed using topsoil and overburden, are to be <br />placed along the permit edge. A commitment to maintain a 2:1 slope during mining means <br />topsoil should be protected from loss in conjunction with seeding for erosion protection <br />4) The Division through its review process has addressed the slope angles and the applicant has <br />agreed to reclaim to 3:1 slopes. <br />5) Per the Rules fora 110c application, a wildlife study is not required. However, the DMG noticed <br />the Division of Wildlife and they responded with a letter stating that there were no issues of great <br />concern. They did make some recommendations on vegetation, etc. Those recommendations do <br />not take into account that the site will be possible used as a home site afrer permit release. <br />6) The applicant will be using silt fencing and a stormwater retention pond to control <br />sedimentation. At this time the requirements of a stormwater permit are still being evaluated. <br />7) Staff raised questions concerning the use of water and it's source as part of the normal review. <br />The Office of State Engineer has been noticed and replied with no issues pertaining to <br />groundwater exposure. The applicant has consulted the local water jurisdiction and is aware of <br />the use requirements for irrigation water from the ditch. If the water source is not approved for <br />commercial /industrial, the applicant will be required to use an approved source.
