We will not mine or <br />extend the highwall closer than seventy (70) feet to the northeast perimeter of the <br />affected area which will allow fifty (50) feet for backfilling and twenty (20) feet for <br />topsoil stockpiles. <br />RECLAMATION PLAN <br />We agree to construct the erosion resistant channels in the 3H:1 V reclaimed slopes as <br />recommended in your letter dated September 8, 1995 and as were used to calculate the <br />bond instead of the upland diversions proposed in our adequacy letter dated August 31, <br />1995. <br />Due to the fact that we are not going to construct the upland diversion ditches, it will not <br />be necessary to allow an additional sixteen (16) feet for adequate clearance for cut and <br />fill method of backfilling the highwall. <br />Please contact me ifyou have any additional questions. <br />Very truly yours, <br />~~~tl~&e~,~ <br />Kathy Weber <br />Weber Sand & Gravel <br />
