Date (if no date stamp): ~ !d d <br />This letter is in regards to the Willits Company Mining and Reclamation permit for the <br />Kattenberg Pit (m-2004-017) which we have spoken about several times. In the most <br />recent conversation you asked that I provide a letter detailing the inaccuracies. Previously <br />I faxed you a copy of Exhibit C with the corrections and on July 6, 2004 I sent a letter to <br />Carl Mount detailing the inaccwacies. <br />As we discussed there are several inaccwacies in the permit that need to be corrected. <br />Adjoining Landowners page 38 <br />• Paula Sheridan and Elizabeth McIntyre (PO Box 2150 Granby Co 80446) own the <br />property immediately south of the pit. Please see attached tax bill from the county <br />assessor labeled Exhibit A. <br />• The Division of Wildlife owns the property at the Southeast corner of the pit. See <br />attached letter from the DOW labeled Exhibit B which was part of the application <br />packet submitted by Mr. Willits. <br />Structures Page 43 and Page 44 <br />• A diversion point and head gate owned by Elizabeth McIntyre and Paula Sheridan <br />as marked on original exhibit C is attached as Exhibit C. The diversion and head <br />gate are within 200 feet of the permit area. <br />The Vail ditch does not run to the west of County Road 60 as described in Exhibit <br />S page 44. This is Keller Creek. Keller Creek is marked on Exhibit C. <br />• The French/Williams fence has been rebuilt and maintained by Elizabeth <br />McIntyre and Paula Sheridan. It should be noted as McIntyre/Sheridan on page <br />44. <br />Thank-you for correcting these inaccuracies.
