'~-1~^^1-~~~ <br />Pursuant to the requirement of the Colorado Mined Land Reclamation Act* to <br />inforrt~counties and certain municipalities of mining and reclamation permit <br />applications filed with this office, please know that Ted R. Hubbs has filed <br />to conduct surface mining at or near Section 13.0, Township 33.0 N, Range 12.0 <br />W, 10th Prime Meridian. The applicant proposes to reclaim the site for <br />general agriculture. <br />The Mined Land Reclamation Board must deny a permit for any proposed mining <br />operation which would be in violation of zoning, subdivision regulations or <br />any master plan for extraction (See C.R.S. 34-32-115(4)(e)). Similarly, the <br />Board cannot grant a permit fora new mining operation if the operator's <br />reclamation plan for an area is inconsistent with an adopted plan by any <br />county, city and county, city, or town unless a prior declaration of intent to <br />change or waive the prohibition is obtained by the applicant from the affected <br />government subdivisions (See C.R.S. 34-32-109(8)). Please return the enclosed <br />form t~~ provide this critical information. <br />The ap~~licant is required to place a copy of the application for public <br />inspecrion with the Clerk of the county in which the proposed mine is <br />situatlyd. This is intended to provide the application for public review and <br />comment;.
