<br />rt. • III IIIIIIIII IIII III <br />• <br />BENT COUNTY ADMINISTRATOR <br />BENT' <br />RECiEIVED <br />June 11, 2001 <br />Mr. James Dillie JUN i 3 2061 <br />Environmental Protection Specialist Division or Minerals and Geology <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Bent County Pit #2 (M-2001-019) <br />This letter and narrative is in response to your letter dated May 22, 2001, and <br />your minerals program inspection report from the inspection of May 9, 2001, <br />wherein you set forth certain requirements which needed to be addressed in <br />connection with the application for this mining permit. Please recognize, Mr. <br />Dillie, that my involvement in any phase of the mine permitting process is <br />extremely limited as this function has heretofore always been handled by Virley <br />Burkhalter, the former Bent County Administrator, now retired. Recognizing from <br />my review of matters related to this application that I may not have adequately <br />addressed those items I respectfully request that after you have had the <br />opportunity to review the materials I have furnished herewith that I be advised at <br />the earliest possible of any discrepancies or omissions. <br />Enclosed with this letter are: <br />(1) Revised first page of the application to reflect the permitted acreage <br />should read 18.51 acres rather than 17.87 acres as originally indicated. This <br />~ change of plus .64 acres is to denote the inclusion of the access road as a part of <br />the permitted area. <br />~ (2) A legal description of the access road as furnished by Peterson Surveying <br />~ which firm provided the initial survey map of the permitted area. <br />(3) A copy of the agreement as executed by the Bent County Commissioners <br />off' addressing Bent County's assumption of liability for any damages, which might <br />result from the mining operation to the Fort Lyon Canal Company. <br />(4) A copy of a letter signed by Alan Dean and Edward Dean wherein they <br />~'~/express and request the access road not be reclaimed at the conclusion of <br />mmmg at this site. <br />(5) A copy of Legal notice No. 2770 as published in the BENT COUNTY <br />DEMOCRAT on May 3, 10, 17, and 24, 2001. <br />P.O.
