Your application has been scheduled for a decision by the <br />Division on April 28, 1993. <br />Before your application can be approved by the Division, you will need *,o address the <br />following adequacy items in order to satisfy the applicable requirements of <br />C.R.S. 34-32-101, et. sec., and the Mineral Rules and Regulations of the Colorado Mined <br />Land Reclamation Board. Please provide a response to each item by April 20, 1993. <br />Adeauacv Items <br />1. The Division will need to have a written clearance from the State Historical <br />Preservation Office (SHPO) before this application can be approved. A copy of the <br />letter from SHPO to the Division is attached for your information. <br />2. Exhibit D -How will the operator guarantee that the original topsoil and overburden <br />stockpiles will be stabilized for the life of the mining operation? <br />3. Exhibit D -Please indicate on a map where the planned low berms and/or diversion <br />ditches will be located for the operation. The Division is particularly concerned that <br />the drainages in and around the permit area are protected for erosion or sedimentation <br />from the mining operation. <br />To adequately review your response to the adequacy review, the Division must receive the <br />required information by April 20, 1993. If we do not receive all the required information by <br />that date, a new date may be set for consideration of the application as provided for under <br />Rule 1.5(2). Also, as provided for under Rule 1.5.1, all changes and additions to the permit <br />application must be filed with the Division and with the County Clerk and Recorder.
