STAT.. OF co~oaAOO uir~~nan n. r,w~~~~„~ ut ^IR^11^Il~till III
999
DEPARTMENT OF NATURAL RESOURCES
D. Monte Pascoe, Executive Director '
11IINED LAND RECLAMATION
423 Centennial Building, 1313 Sherman Street
Denver, Colorado 80203 Tel. (303) 639-3567
November l0, 1980
Mr. Don Rapp
8730 W. Mountain View Lane
Littleton, Colorado 80125
RE: Fremont Paving - MacKenzie Pit
Our File # 80-224
Dear Mr. Rapp:

David ~. Shelton
Director
I received the application for Fremont Paving's MacKenzie Pit today.
I would like to accomodate your request to put this on the agenda for
the November meeting, but I cannot. Because of the Thanksgiving holi-
day, the meeting has been moved up to November 19-20, phis month.
Therefore, there wilt not be time for publication requirements to be
met before the meeting. The December meeting, however, is also early
(Dec. 17-18), and I will schedule this operation for that meeting.
I plan to send my completeness letter out on this operation on Nov. 19.
If you prefer, I will send this letter (with the publication format on
the back) to you instead of to Mr. Bryan. Please let me know about
this.
I was in error concerning the need for proof of legal right to enter.
This is still required by the Act for limited impact operations.
Since this was my error during my conversation with you, I will call
the application complete even without this proof, but I will need it
before the December Board meeting.
The $125.00 check sent as an application fee is too large fora 5-acre
operation. The fee should he $75.00. I will return or destroy the
$125.00 check as you instruct me, and Mr. Bryan may then replace it
' with a $75.60 check. -
I should also mention that, although the application is complete in
this regard, I still need a statement from the Division of Wildlife
concerning wildlife impacts of the operation (before Dec. meeting).
I will do a more complete review and send out an adeouac}' letter
following the complete letter. This will allow us to resolve any out-
standing questions prior to the December meeting. Please call me when
you return on November 12, and we can discuss this more fully.
Sincerely,
Mark S. Loge
Reclamation Specialist
